All content on the site dileviathan.fr (texts, illustrations, videos, structure, graphic charter) is the exclusive property of FLYING KUJIRA, unless otherwise stated.
Any reproduction, representation, modification, publication, or adaptation of all or part of the site's elements, by any means or process whatsoever, is prohibited without the prior written authorisation of FLYING KUJIRA.
Any unauthorised use of the site or any of the elements it contains will be considered an act of infringement and prosecuted in accordance with the provisions of Articles L.335-2 et seq. of the French Intellectual Property Code.
4. Personal Data
In accordance with the General Data Protection Regulation (GDPR) and the French Data Protection Act, FLYING KUJIRA undertakes to ensure that the collection and processing of your personal data comply with the following principles:
- Purpose: Email addresses collected via the newsletter sign-up form are used exclusively to enable you to receive novel chapters and blog articles. They are under no circumstances used for any other purpose, nor sold or rented to third parties.
- Newsletter (Listmonk): Subscription management is handled by Listmonk, a self-hosted open-source application running on our own servers (GDPR-ready solution). Sign-up uses a double opt-in process: you receive a confirmation email before your subscription is activated. Your data (email address, chapter/blog preferences) is stored in France and is never shared with third parties.
- Consent: By signing up, you expressly consent to receiving these communications.
- Right of withdrawal: You may unsubscribe at any time via the link included in every email or directly on the unsubscribe page.
- Retention period: Data is retained until active unsubscription or a deletion request is made.
Your rights: In accordance with the General Data Protection Regulation (GDPR), you have the right to access, rectify, erase, and port your data. You may exercise all of these rights at any time by contacting us at: christophe@dileviathan.fr.
5. Analytics (Matomo)
The site dileviathan.fr uses Matomo, a free and open-source analytics solution, self-hosted on our own servers (OVH, France). No third party has access to browsing data.
Tracking is configured without cookies ("cookieless" mode) with IP address anonymisation. In accordance with the recommendations of the CNIL, this analytics configuration does not require prior consent.
Browsing data is stored on our servers and is never transmitted, sold, or shared with third parties.
6. Cookies
The site dileviathan.fr does not place any tracking or advertising cookies. Matomo analytics operates without cookies (see section 5).
A single strictly technical cookie is used: NEXT_LOCALE (language preference fr/en), valid for the duration of your browsing session. The dark/light theme preference is stored locally in your browser (localStorage), without any cookie.
You may configure your browser to refuse cookies or to be notified when a cookie is placed.
7. Limitation of Liability
The novel Dileviathan — We Are the Guardians is a work of fiction. Any resemblance to real persons or situations, past or present, would be purely coincidental.
FLYING KUJIRA shall not be held liable for any direct or indirect damages resulting from the use of the site or the inability to access it.
8. Applicable Law
These legal notices are governed by French law. In the event of a dispute, and in the absence of an amicable resolution, the French courts shall have sole jurisdiction.
